2222 The bill requires that, immediately after a railroad notifies the
2323 state's watch center in the department of public safety (watch center) of
2424 an emergency involving a train, the watch center must notify the public
2525 utilities commission (commission) and the office of rail safety (office) of
2626 the incident. The commission is required to submit a report to specified
2727 committees of the general assembly on the information reported by
2828 railroads regarding an emergency involving a train.

4742 railroad crossing. A railroad or a crew member is immune from civil
4843 liability and is not liable in civil damages for actions taken in good faith
4944 in the course of a response to an emergency situation involving a train.
5045 The bill eliminates the shared authority that the commission, the
5146 department of public safety, and the department of transportation had to
5247 inspect and investigate railroads and grants the commission alone the
5348 authority to inspect, investigate, and regulate the following railroads:
5449 ! A class I railroad;
5550 ! A railroad operating any line that was used by class I
5651 railroads as of July 1, 2024; and
5752 ! A passenger railroad.
5853 The bill requires the office to gather, analyze, and assess
5954 information, including:
6055 ! Data to create a more comprehensive understanding of
6156 railroad safety;
6257 ! An assessment of the state's ability to respond to a
6358 large-scale release of hazardous materials from railroad
6459 transportation;
6560 ! The best practices for ensuring financial responsibility for
6661 response, cleanup, and damages from major rail events,
6762 including reviewing best practices from other states; and
6863 ! Communication issues impacting railroad lines in the state.
6964 A railroad regulated by the commission is required to pay a fee to
7065 cover the costs incurred by the commission and the office in relation to
7166 the bill. The commission shall determine a methodology for calculating
7267 the fee by rule, but the commission must include specified criteria in the
7368 calculation. A railroad regulated by the commission must pay the fee in
7469 equal quarterly installments and is subject to penalties and interest if they
7570 fail to timely pay the fee.
7671 Be it enacted by the General Assembly of the State of Colorado:1
7772 SECTION 1. Legislative declaration. (1) The general assembly2
7873 finds that:3
7974 (a) The safety and efficiency of Colorado's rail infrastructure is4
8075 critical to protecting public health, ensuring environmental sustainability,5
8176 and supporting economic vitality;6
8277 (b) Railroad transportation is a critical component of Colorado's7
8378 162-2- economy and provides efficient and cost-effective movement of goods1
8479 across the state and beyond;2
8580 (c) Colorado's fragile ecosystems, weather extremes, extensive3
8681 number of hard-to-maintain and difficult-to-access railroad track miles,4
8782 and number of communities through which railroads operate necessitate5
8883 a state office of rail safety;6
8984 (d) The office of rail safety needs the authority and resources to7
9085 address all railroad safety disciplines, including crossings, track, signal8
9186 and train control, motive power and equipment, operating practices,9
9287 compliance, and hazardous materials; 10
9388 (e) The establishment of the office of rail safety in the public11
9489 utilities commission provides a dedicated, state-led approach to rail12
9590 inspection, enforcement, and risk mitigation. By securing funding for the13
9691 office, Colorado will be in line with 30 other states across the country that14
9792 have rail safety programs and will enhance its ability to conduct safety15
9893 inspections, enforce rail regulations, and coordinate with federal and local16
9994 partners to prevent accidents and respond effectively to rail-related17
10095 incidents. Reducing the risk of accidents, derailments, and other incidents18
10196 associated with railroad transportation lowers costs, improves efficiency,19
10297 and reduces liability for railroad companies;20
10398 (f) Railroads should not face multiple fee structures to support rail21
10499 safety. A new office of rail safety fund should provide a single funding22
105100 source for the office of rail safety and the regulation of highway-rail23
106101 grade crossing safety for subject railroads.24
107102 (2) Therefore, the general assembly declares that Colorado must25
108103 fund the office of rail safety to fulfill its mandate of ensuring that rail26
109104 operations in Colorado meet the highest standards of safety and27
