4944 The bill requires the state board of health (board) to allow the
5045 Colorado youth advisory council to present to the board twice a year on
5146 issues regarding the youth opioid epidemic and other health issues. The
5247 bill also requires the board to consult the council when the board engages
5348 in its rule-making authority regarding opioid antagonists.
5449 Under current law, a school district, the state charter school
5550 institute, or a governing board of a nonpublic school may adopt and
5651 implement a policy that allows:
5752 ! A school to acquire and maintain a stock supply of opioid
5853 antagonists on school grounds or on a school bus;
5954 ! A school employee or agent who has received relevant
6055 training to administer an opioid antagonist to a person who
6156 is at risk of experiencing an opioid-related overdose; and
6257 ! A school employee or agent to furnish an opioid antagonist
6358 to any individual, including a student, if the student has
6459 received relevant training.
6560 The bill:
6661 ! Permits a school to maintain an opioid antagonist in an
6762 automated external defibrillator or defibrillator cabinet in
6863 the school or on a school bus;
6964 ! Repeals the requirement that a school employee or agent
7065 must receive training prior to administering an opioid
7166 antagonist; and
7267 ! Creates an exception that a school employee or agent may
7368 furnish an opioid antagonist to a student who has not
7469 received relevant training if the employee or agent believes
7570 that the student is in a position to assist an individual who
7671 is suffering from an opioid-related drug overdose event or
7772 who is at risk of experiencing an opioid-related drug
7873 overdose event.
7974 Current law provides a specific list of eligible entities that a
8075 prescriber may prescribe or dispense an opioid antagonist to. The bill
8176 eliminates the specific list and instead requires the state board of health
8277 to establish a list of eligible entities that a prescriber may prescribe or
8378 dispense an opioid antagonist to.
8479 The bill creates a standing order allowing all eligible entities to
8580 distribute opioid antagonists.
8681 The bill requires the department of public health and environment
8782 to furnish a report detailing youth overdose prevention during "SMART
8883 Act" hearings.

257252 for overdose, including instruction concerning risk factors for overdose,14
258253 recognizing an overdose, calling emergency medical services, rescue15
259254 breathing, and administering an opioid antagonist.16
260255 (3) A prescriber described in subsection (7)(h) of this section does17
261256 not engage in unprofessional conduct or is not subject to discipline18
262257 pursuant to section 12-240-121, 12-255-120, or 12-280-126, as19
263258 applicable, if the prescriber issues standing orders and protocols20
264259 regarding opioid antagonists or prescribes or dispenses, pursuant to an21
265260 order or standing orders and protocols, an opioid antagonist in a good22
266261 faith effort to assist:23
267262 (c) A person or AN ELIGIBLE entity described in subsection (1)(a)24
268263 of this section SECTION 25-1.5-115.1 (1), in responding to, treating, or25
269264 otherwise assisting an individual who is experiencing or is at risk of26
270265 experiencing an opioid-related drug overdose event or a friend, family27

273268 (4) (b) A person or AN ELIGIBLE entity described in subsection2
274269 (1)(a) of this section SECTION 25-1.5-115.1 (1) acting in accordance with3
275270 this section is not subject to civil liability or criminal prosecution, as4
276271 specified in sections 13-21-108.7 (3) and 18-1-712 (2), respectively.5

317312 substance, including fentanyl, carfentanil, benzimidazole opiate, or an15
318313 analog thereof as described in section 18-18-204 (2)(g), in accordance16
319314 with applicable law. As used in this subsection (6), "safe disposal" means17
320315 the procedure and process for depositing the controlled substance,18
321316 including fentanyl, carfentanil, benzimidazole opiate, or an analog thereof19
322317 as described in section 18-18-204 (2)(g), in a secure container for law20
323318 enforcement to subsequently access and dispose of.21
324319 SECTION 10. Act subject to petition - effective date. This act22
325320 takes effect at 12:01 a.m. on the day following the expiration of the23
326321 ninety-day period after final adjournment of the general assembly; except24
327322 that, if a referendum petition is filed pursuant to section 1 (3) of article V25
328323 of the state constitution against this act or an item, section, or part of this26
329324 act within such period, then the act, item, section, or part will not take27

331326 -10- effect unless approved by the people at the general election to be held in1
332327 November 2026 and, in such case, will take effect on the date of the2
333328 official declaration of the vote thereon by the governor.3
