The bill clarifies that a special district may cancel an election in a director district if the only matter to be decided at the election is who will be director of the director district, there are not more candidates than positions for director, and the only individuals who may vote are the eligible electors within the director's district. In Colorado Revised Statutes, 1-13.5-513, amend2 (4); and add (3.5) as follows:3 1-13.5-513. Election may be canceled - when - definition.4 (3.5) (a) I F, PURSUANT TO SECTION 32-1-902.7, THE BOARD OF DIRECTORS5 OF A SPECIAL DISTRICT HAS ADOPTED A RESOLUTION TO DIVIDE THE6 SPECIAL DISTRICT INTO DIRECTOR DISTRICTS AND HAS DESIGNATED THAT7 THE DIRECTORS REPRESENTING THE DIRECTOR DISTRICTS MUST BE8 ELECTED BY THE ELIGIBLE ELECTORS WITHIN EACH DIRECTOR DISTRICT ,9 THEN THE GOVERNING B ODY MAY CANCEL THE ELECTION FOR ONE OR10 MORE DIRECTOR DISTRICTS IF, WITH RESPECT TO EACH SUCH DIRECTOR11 DISTRICT, ALL THE CONDITIONS OF SUBSECTION (1) OF THIS SECTION EXIST12 AND ALL BALLOT ISSUES OR BALLOT QUESTIONS , IF ANY, HAVE BEEN13 WITHDRAWN FROM THE BALLOT PURSUANT TO SUBSECTION (2) OF THIS14 SECTION.15 (b) A S USED IN THIS SUBSECTION (3.5), "DIRECTOR DISTRICT"16 MEANS THE AREA REPRESENTED BY ONE DIRECTOR WITHIN A SPECIAL17 DISTRICT IN WHICH THE BOARD HAS ADOPTED A RESOLUTION TO DIVIDE18 THE SPECIAL DISTRICT INTO DIRECTOR DISTRICTS PURSUANT TO SECTION19 32-1-902.7.20 (4) Except as provided in subsection (2) SUBSECTIONS (2) AND21 (3.5) of this section, no election may be canceled in part.22 SECTION 2. Act subject to petition - effective date -23 applicability. (1) This act takes effect at 12:01 a.m. on the day following24 the expiration of the ninety-day period after final adjournment of the25 general assembly; except that, if a referendum petition is filed pursuant26 172-2- to section 1 (3) of article V of the state constitution against this act or an1 item, section, or part of this act within such period, then the act, item,2 section, or part will not take effect unless approved by the people at the3 general election to be held in November 2026 and, in such case, will take4 effect on the date of the official declaration of the vote thereon by the5 governor.6 (2) This act applies to elections held on or after the applicable7 effective date of this act.8 172 -3-
