4440 Be it enacted by the General Assembly of the State of Colorado:1
4541 SECTION 1. In Colorado Revised Statutes, 24-34-104, repeal2
4642 (26)(a)(IV); and add (31)(a)(XIV) as follows:3

4844 and functions for repeal, continuation, or reestablishment - legislative5
4945 declaration - repeal. (26) (a) The following agencies, functions, or both,6
5046 are scheduled for repeal on September 1, 2025:7
5147 (IV) The rural alcohol and substance abuse prevention and

5349 treatment program created pursuant to section 27-80-117 in the9
5450 behavioral health administration in the department of human services;10
5551 (31) (a) The following agencies, functions, or both, are scheduled11

6258 SECTION 2. In Colorado Revised Statutes, 27-80-117, amend17
6359 (3)(a) and (4)(a) as follows:

6561 27-80-117. Rural alcohol and substance abuse prevention and19
6662 treatment program - creation - administration - cash fund -20
6763 definitions - repeal. (3) (a) There is created in the state treasury the rural21
6864 alcohol and substance abuse cash fund, referred to in this section as the22
6965 "fund", that consists of the rural youth alcohol and substance abuse23
7066 prevention and treatment account, referred to in this section as the "youth24
7167 195-2- account", and the rural detoxification account, referred to in this section1
7268 as the "detoxification account". The fund is comprised of money collected2
7369 from surcharges assessed pursuant to sections 18-19-103.5, 42-4-13073
7470 (10)(d)(I), and 42-4-1701 (4)(f). The money collected from the surcharges4
7571 must be divided equally between the youth account and the detoxification5
7672 account. The fund also includes any money credited to the fund pursuant6
7773 to subsection (3)(b) of this section. Money in the fund credited pursuant7
7874 to subsection (3)(b) of this section must be divided equally between the8
7975 youth account and the detoxification account unless the grantee or donor9
8076 specifies to which account the grant, gift, or donation is to be credited.10
8177 The money in the fund is subject to annual appropriation by the general11
8278 assembly to the BHA for the purpose of implementing the program. All12
8379 interest derived from the deposit and investment of money in the fund13
8480 remains in the fund. Any unexpended or unencumbered money remaining14
8581 in the fund at the end of a fiscal year remains in the fund and shall not be15
8682 transferred or credited to the general fund or another fund; except that any16
8783 unexpended and unencumbered money remaining in the fund as of17
8884 August 30, 2025 AUGUST 30, 2030, is credited to the general fund.18
8985 (4) (a) This section is repealed, effective September 1, 202519

9389 SECTION 3. In Colorado Revised Statutes, 18-19-103.5, amend21
9490 (4) as follows:22
9591 18-19-103.5. Rural alcohol and substance abuse surcharge -23
9692 repeal. (4) This section is repealed, effective September 1, 202524

9995 rural alcohol and substance abuse prevention and treatment program26

10298 -3- SECTION 4. In Colorado Revised Statutes, 42-4-1307, amend1

106102 costs and surcharges. In addition to the penalties prescribed in this5

108104 (d) (II) This paragraph (d) SUBSECTION (10)(d) is repealed,7
109105 effective September 1, 2025 SEPTEMBER 1, 2030, unless the general8
110106 assembly extends the repeal of the rural alcohol and substance abuse9
111107 prevention and treatment program created in section 27-80-117.10
112108 SECTION 5. In Colorado Revised Statutes, 42-4-1701, amend11
113109 (4)(f)(III) as follows:12
114110 42-4-1701. Traffic offenses and infractions classified -13
115111 penalties - penalty and surcharge schedule - repeal. (4) (f) (III) This14
116112 paragraph (f) SUBSECTION (4)(f) is repealed, effective September 1, 202515

118114 EPTEMBER 1, 2030, unless the general assembly extends the repeal of the16
119115 rural alcohol and substance abuse prevention and treatment program17
120116 created in section 27-80-117.18
121117 SECTION 6. Act subject to petition - effective date. This act19
122118 takes effect at 12:01 a.m. on the day following the expiration of the20
123119 ninety-day period after final adjournment of the general assembly; except21
124120 that, if a referendum petition is filed pursuant to section 1 (3) of article V22
125121 of the state constitution against this act or an item, section, or part of this23
126122 act within such period, then the act, item, section, or part will not take24
127123 effect unless approved by the people at the general election to be held in25
128124 November 2026 and, in such case, will take effect on the date of the26
129125 official declaration of the vote thereon by the governor.27
