12-Be it enacted by the General Assembly of the State of Colorado:
13-SECTION 1. In Colorado Revised Statutes, 17-42-103, amend
14-(1.5) introductory portion, (1.5)(b), and (1.5)(c); and add (1.5)(d) as
15-follows:
16-17-42-103. Policies concerning inmates' use of telephones -
17-excessive rates prohibited - transparency of communications services
18-in correctional facilities - report - definitions. (1.5) In administering the
19-use of penal communications services pursuant to subsection (1) of this
20-section, access to penal communications services must not be limited
21-beyond what is necessary for routine facility operations. The department
22-shall provide penal communications services, excluding video calls or

23+Joint Budget Committee. Under current law, beginning July 1,
24+2025, the department of corrections is required to cover 100% of all
25+inmate phone call costs. The bill changes the amount the department of
26+corrections is required to cover, beginning July 1, 2025, to 75% of all
27+inmate phone call costs. The bill requires the department of corrections

41-(d) BEGINNING JULY 1, 2026, AND THEREAFTER, THE DEPARTMENT
42-SHALL COVER ONE HUNDRED PERCENT OF ALL PENAL COMMUNICATIONS

45-SECTION 2. Appropriation. For the 2025-26 state fiscal year,
46-$1,436,165 is appropriated to the department of corrections for use by
47-institutions. This appropriation is from the general fund. To implement this
48-act, the institutions may use this appropriation for inmate telephone calls.
49-SECTION 3. Safety clause. The general assembly finds,
50-determines, and declares that this act is necessary for the immediate
51-preservation of the public peace, health, or safety or for appropriations for
