44	38		use of the Centennial correctional facility-south c-tower to only after the
45	39		department of corrections determines that there are no suitable beds
46	40		available to house an inmate in another department facility.
47	41		The bill appropriates $1,829,000 from the general fund to the
48	42		department of corrections to implement the bill.
49	43		Be it enacted by the General Assembly of the State of Colorado:1
50	44		SECTION 1. Legislative declaration. The general assembly2
51	45		finds that the temporary use of c-tower at Centennial correctional3
52	46		facility-south is necessary to accommodate the impact of the access4
53	47		controls capital renewal project at the Sterling correctional facility. It is5
54	48		the general assembly's intent that major accommodations of this kind be6
55	49		considered by the capital development committee in the future.7
56	50		SECTION 2. In Colorado Revised Statutes, 17-1-104.3, add8
57	51		(1)(b.6) as follows:9
58	52		17-1-104.3. Correctional facilities - locations - security level -10
59	53		report - repeal. (1) (b.6) (I) N
60	54		OTWITHSTANDING ANY OTHER PROVISION11
61	55		OF LAW TO THE CONTRARY , THE CENTENNIAL CORRECTIONAL12
62	56		FACILITY-SOUTH C-TOWER MAY BE USED TO TEMPORARILY HOUSE13
63	57		PROTECTIVE-, CLOSE-, AND MEDIUM-CUSTODY INMATES FOR THE STERLING14
64	58		CORRECTIONAL FACILITY ACCESS CONTROLS PROJECT , FOR THE DURATION15
65	59		OF THAT PROJECT, AND FOR THE TIME REQUIRED TO TEMPORARILY16
66	60		RELOCATE THE INMATES AND THEN RETURN THEM TO THE STERLING17
67	61		CORRECTIONAL FACILITY. TO THE EXTENT FEASIBLE, THE DEPARTMENT18
68	62		SHALL HOUSE AN INMATE FROM THE STERLING CORRECTIONAL FACILITY19
69	63		IN THE CENTENNIAL CORRECTIONAL FACILITY -SOUTH C-TOWER ONLY20
70	64		AFTER DETERMINING THAT THERE ARE NO SUITABLE BEDS AVAILABLE21

77		-	SECTION 3. Appropriation. For the 2025-26 state fiscal year,6
78		-	$1,829,000 is appropriated to the department of corrections for use by7
79		-	institutions. This appropriation is from the general fund. To implement8
80		-	this act, the institutions may use this appropriation for Centennial9
81		-	correctional facility-south c-tower start-up costs related to the10
82		-	superintendents subprogram.11
83		-	SECTION 4. Safety clause. The general assembly finds,12
84		-	determines, and declares that this act is necessary for the immediate13
85		-	preservation of the public peace, health, or safety or for appropriations for14
86		-	the support and maintenance of the departments of the state and state15
87		-	institutions.16

	83	+	PROGRAM, AND THE LOCATION WHERE EACH PROGRAM WILL BE14
