12-Be it enacted by the General Assembly of the State of Colorado:
13-SECTION 1. In Colorado Revised Statutes, repeal 24-48.5-122 as
14-follows:
15-24-48.5-122. Local business mobile application software -
16-creation - legislative declaration - definitions. (1) The general assembly
17-hereby finds, determines, and declares that the Colorado office of economic
18-development is directed to contract for the development of local business
19-mobile application software in order to:
20-(a) Assist consumers in the state who wish to find and patronize
21-local businesses;
22-NOTE: This bill has been prepared for the signatures of the appropriate legislative
23-officers and the Governor. To determine whether the Governor has signed the bill
24-or taken other action on it, please consult the legislative status sheet, the legislative
25-history, or the Session Laws.

29-the act. (b) Allow such businesses to publicize their Colorado affiliations;

31-(c) Consistent with the office's duties, promote economic growth
32-through the expansion of businesses in the state.
33-(2) As used in this section, unless the context otherwise requires:
34-(a) "Local business" means a business that is owned, located, or
35-headquartered in, or manufactures in, Colorado.
36-(b) "Office" means the Colorado office of economic development
37-created in this part 1.
38-(3) (a) The office shall contract for the creation, management,
39-operation, and maintenance within the office of mobile application software
40-to be known as the "By Colorado App", which software enables users to
41-learn about local businesses that elect to participate in the software.
42-(b) The software developed pursuant to paragraph (a) of this
43-subsection (3) must be operational on or before January 1, 2015.
44-(c) The office shall make the local business mobile application
45-software searchable by the types of goods or services offered, location, the
46-type of Colorado affiliation described under paragraph (a) of subsection (2)
47-of this section that qualifies the businesses as a "local business", and any
48-other factors the office deems appropriate.
49-(d) The office shall make the data in the local business mobile
50-application database available to other application developers. In so doing,
51-the office shall take all appropriate steps to maintain the security of the
52-database and the information used therein.
53-(e) The office may register a trademark with the United States patent
54-and trademark office or file a trademark with the Colorado secretary of state
55-for the "By Colorado App" developed under this section.
56-(4) The office is authorized to accept and expend gifts, grants, and
57-donations for information technology costs incurred in creating, managing,
58-PAGE 2-SENATE BILL 25-224 operating, and maintaining the mobile application software developed
59-pursuant to this section. The general assembly finds that the implementation
60-of this section is not entirely dependent on the receipt of any gifts, grants,
61-and donations.
62-SECTION 2. Safety clause. The general assembly finds,
63-determines, and declares that this act is necessary for the immediate
64-preservation of the public peace, health, or safety or for appropriations for

66-institutions.
