ONCERNING THE CONVERSION OF CONTINUOUSLY APPROPRIATED CASH
FUNDS TO CASH FUNDS SUBJECT TO ANNUAL APPROPRIATION BY THE
GENERAL ASSEMBLY
, AND, IN CONNECTION THEREWITH, MAKING AN
APPROPRIATION
.
Be it enacted by the General Assembly of the State of Colorado:
SECTION 1. In Colorado Revised Statutes, 26-6-921, amend
(4)(b) as follows:
26-6-921.  Civil penalties - fines - child welfare cash fund -
created. (4) (b)  The balance as of July 1, 2022, in the child care cash fund,
created pursuant to section 26-6-114 (5), as it existed prior to July 1, 2022,
that is attributable to fines and civil penalties collected by the division in the
department that is responsible for child welfare is hereby
 transferred to the
child welfare cash fund, which fund is hereby created in the state treasury.
The treasurer shall credit all interest derived from the deposit and
investment of money in the child welfare cash fund to the fund. At the end

quality of child care in the state of Colorado.
SECTION 2. In Colorado Revised Statutes, 25-7-129, amend (3)(e)
as follows:
25-7-129.  Disposition of fines - community impact cash fund -
repeal. (3) (e)  Money in the fund is continuously appropriated to
 SUBJECT
TO ANNUAL APPROPRIATION BY THE GENERAL ASSEMBLY
, the department
MAY EXPEND MONEY FROM THE FUND to accomplish the purposes set forth
in this subsection (3).
SECTION 3. In Colorado Revised Statutes, 39-2-125, amend
(2.5)(b)(II) as follows:
39-2-125.  Duties of the board - board of assessment appeals cash
fund - creation - accelerated appeal cash fund. (2.5) (b)  The board of
assessment appeals may charge a fee to a taxpayer whose appeal is
advanced pursuant to this subsection (2.5). The fee must be:
(II)  Deposited in the accelerated appeal cash fund, which is hereby
created in the state treasury. The state treasurer shall credit all interest and
income derived from the deposit and investment of money in the fund to the
fund. Money in the fund is continuously appropriated to
 SUBJECT TO
ANNUAL APPROPRIATION BY THE GENERAL ASSEMBLY
, the board of
assessment appeals 
MAY EXPEND MONEY FROM THE FUND to defray the costs
associated with advancing a taxpayer's appeal. 
SECTION 4. In Colorado Revised Statutes, 38-12-1110, amend (1)
as follows:
38-12-1110.  Mobile home park act dispute resolution and
enforcement program fund. (1)  There is hereby
 created in the state
treasury the mobile home park act dispute resolution and enforcement
program fund. All money collected pursuant to the program must be
PAGE 2-SENATE BILL 25-265 deposited in the fund. The fund shall be used by the division for the costs
associated with administering the program. The money in the fund shall be
continuously appropriated for administering SUBJECT TO ANNUAL
APPROPRIATION BY THE GENERAL ASSEMBLY
, THE DIVISION MAY EXPEND
MONEY FROM THE FUND TO ADMINISTER
 the program. All interest and
income derived from the investment and deposit of money in the fund shall
be credited to the fund. Any unexpended and unencumbered money
remaining in the fund at the end of a fiscal year shall remain in the fund and
shall not be credited or transferred to the general fund or another fund.
SECTION 5. In Colorado Revised Statutes, 24-33.5-2502, amend
(2)(e) as follows:
24-33.5-2502.  Office of public safety communications - public
safety communications revolving fund - creation. (2) (e)  Money in the
fund is continuously appropriated to SUBJECT TO ANNUAL APPROPRIATION
BY THE GENERAL ASSEMBLY
, the office MAY EXPEND MONEY FROM THE
FUND
 to pay the direct and indirect costs, including personal services and
operating costs, associated with administering public safety
communications.
SECTION 6. In Colorado Revised Statutes, 24-30-2304, amend (4)
as follows:
24-30-2304.  Revolving fund - definition. (4)  Money in the fund
is continuously appropriated to SUBJECT TO ANNUAL APPROPRIATION BY THE
GENERAL ASSEMBLY
, the department MAY EXPEND MONEY FROM THE FUND
to be used for the purposes specified in subsection (2) of this section.
SECTION 7. Appropriation. For the 2025-26 state fiscal year,
$284,167 is appropriated to the department of human services for use by the
division of child welfare. This appropriation is from the child welfare cash
fund created in section 26-6-921 (4)(b), C.R.S. To implement this act, the
division may use this appropriation for child welfare licensing.
SECTION 8. Effective date. This act takes effect July 1, 2025.
SECTION 9. Safety clause. The general assembly finds,
determines, and declares that this act is necessary for the immediate
preservation of the public peace, health, or safety or for appropriations for
