10-Be it enacted by the General Assembly of the State of Colorado:
11-SECTION 1. In Colorado Revised Statutes, repeal 24-75-114 as
12-follows:
13-24-75-114. Appropriations for utilities - roll-forward spending
14-authority - definition. (1) As used in this section, unless the context
15-otherwise requires, "utilities" has the same meaning as set forth in section
16-24-75-112 (1)(q).
17-(2) Subject to fiscal rules promulgated by the state controller, any
18-unexpended and unencumbered money appropriated to a department in a
19-specific line item for utilities in a fiscal year commencing on or after July
20-1, 2021, remains available for expenditure in the next fiscal year without
21-further appropriation for the department to purchase utilities conservation
22-NOTE: This bill has been prepared for the signatures of the appropriate legislative

36-determines, and declares that this act is necessary for the immediate
37-preservation of the public peace, health, or safety or for appropriations for

22+Joint Budget Committee. Currently, a state department may use
23+unexpended and unencumbered money from the department's utilities line
24+item to purchase energy conservation equipment and services without
25+further appropriation. The bill eliminates this roll-forward authority.
