The capitol building advisory committee (advisory committee) is currently required to evaluate and make recommendations to the capital development committee and, in some cases, the governor regarding proposals for the gift or loan of art and memorials to be placed on a permanent or temporary basis in the capitol building or on its surrounding grounds. Dashes through the words or numbers indicate deletions from existing law. its surrounding grounds and the public areas of the legislative services building and its surrounding grounds to the advisory committee's purview in connection with proposals for the gift or loan of art and memorials. In addition, current law specifies that the art, memorials, architectural fixtures, and furniture that are original to the capitol building must remain in the capitol building at all times unless the items are temporarily removed for conservation. The bill allows the removal of items original to the capitol building for loan, exhibit, research, or disposition with the approval of the advisory committee. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 24-82-108, amend2 (3)(h)(I), (3)(h)(III), and (3.5)(c) as follows:3 24-82-108. State capitol building advisory committee -4 creation - duties - legislative declaration - repeal. (3) Duties of the5 advisory committee. The advisory committee has the duties specified in6 subsections (3)(a) through (3)(i) of this section.7 (h) Proposals for a gift or loan of art and memorials. (I) Except8 as provided in subsection (3)(h)(II) of this section, all proposals involving9 the gift or loan of objects of art and memorials to be placed on a10 permanent or temporary basis in the state capitol building or on its11 surrounding grounds, IN THE PUBLIC AREAS OF THE CAPITOL BUILDING12 ANNEX OR ON ITS SURROUNDING GROUNDS , OR IN THE PUBLIC AREAS OF13 THE LEGISLATIVE SERVICES BUILDING OR ON ITS SURROUNDING GROUNDS ,14 and proposals for fund-raising efforts to place objects of art or memorials15 in the state capitol building or on its surrounding grounds, IN THE PUBLIC16 AREAS OF THE CAPITOL BUILDING ANNEX OR ON ITS SURROUNDING17 GROUNDS, OR IN THE PUBLIC AREAS OF THE LEGISLATIVE SERVICES18 BUILDING OR ON ITS SURROUNDING GROUNDS shall be submitted to the19 advisory committee for evaluation. The advisory committee shall develop20 287-2- criteria and a procedure for such evaluations, which shall include1 consulting with knowledgeable advisors to assist in evaluating each2 object of art or memorial individually. The advisory committee shall3 evaluate all proposals submitted to the advisory committee and present4 recommendations resulting from the evaluations as follows:5 (A) Proposals involving the gift or loan of objects of art and6 memorials pertaining to all public areas of the state capitol building,7 including but not limited to the corridors, rotunda, lobbies, entrance ways,8 stairways, restrooms, porticos, steps, and elevators, ALL PUBLIC AREAS OF9 THE CAPITOL BUILDING ANNEX , AND ALL PUBLIC AREAS OF THE10 LEGISLATIVE SERVICES BUILDING must be submitted to the capital11 development committee for approval. No such proposal shall proceed12 without the prior approval of the capital development committee.13 (B) Proposals involving the gift or loan of objects of art and14 memorials pertaining to the surrounding grounds of the capitol building15 bounded by Colfax avenue on the north, Grant street on the east,16 Fourteenth avenue on the south, and Broadway on the west, in the city17 and county of Denver, must be submitted to the capital development18 committee and the governor for approval. I N ADDITION, PROPOSALS19 INVOLVING THE GIFT OR LOAN OF OBJECTS OF ART AND MEMORIALS20 PERTAINING TO THE SURROUNDING GROUNDS OF THE CAPITOL BUILDING21 ANNEX OR THE SURROUNDING GROUNDS OF THE LEGISLATIVE SERVICES22 BUILDING MUST BE SUBMITTED TO THE CAPITAL DEVELOPMENT23 COMMITTEE AND THE GOVER NOR FOR APPROVAL . No such proposal shall24 proceed without the prior approval of the capital development committee25 and the governor.26 (III) The advisory committee is authorized to direct the removal27 287 -3- of any objects of art or memorials that are placed in the state capitol1 building or on its surrounding grounds, IN THE PUBLIC AREAS OF THE2 CAPITOL BUILDING ANNEX OR ON ITS SURROUNDING GROUNDS , OR IN THE3 PUBLIC AREAS OF THE LEGISLATIVE SERVICES BUILDING OR ON ITS4 SURROUNDING GROUNDS that have not been submitted to the advisory5 committee for evaluation and approval pursuant to the criteria and6 procedure developed by the advisory committee pursuant to subsection7 (3)(h)(I) of this section. This subsection (3)(h)(III) does not apply to8 objects of art or memorials placed prior to the formation of the advisory9 committee.10 (3.5) Items original to the state capitol building. (c) The art,11 memorials, architectural fixtures, and furniture that is ARE original to the12 state capitol building, regardless of whether it is THEY ARE part of the13 Colorado collection pursuant to subsection (3)(d) of this section, must14 remain in the state capitol building at all times; except that such items15 original to the capitol building may be temporarily removed from the16 capitol building for conservation, LOAN, EXHIBIT, RESEARCH, OR17 DISPOSITION from time to time with the approval of the advisory18 committee.19 SECTION 2. Act subject to petition - effective date. This act20 takes effect at 12:01 a.m. on the day following the expiration of the21 ninety-day period after final adjournment of the general assembly; except22 that, if a referendum petition is filed pursuant to section 1 (3) of article V23 of the state constitution against this act or an item, section, or part of this24 act within such period, then the act, item, section, or part will not take25 effect unless approved by the people at the general election to be held in26 287 -4- November 2026 and, in such case, will take effect on the date of the1 official declaration of the vote thereon by the governor.2 287 -5-
