3535 healthcare affordability and sustainability enterprise (enterprise) to
3636 distribute provider stabilization payments to safety net providers who
3737 provide services to low-income, uninsured individuals on a sliding-fee
3838 schedule or at no cost. Provider stabilization payments will be distributed
3939 to eligible safety net providers based on the proportion of low-income,
4040 uninsured individuals that an individual provider serves in comparison to
4141 the total number of low-income, uninsured individuals served by all
4242 eligible safety net providers.
4343 The bill directs the state treasurer to credit interest earnings on the
4444 principal in the unclaimed property trust fund to the provider stabilization
4545 fund as follows:
4646 ! $25 million for the 2025-26 state fiscal year;
4747 ! $20 million for the 2026-27 state fiscal year; and
4848 ! $15 million for the 2027-28 and subsequent state fiscal
4949 years.
5050 The provider stabilization fund also consists of any money the
5151 general assembly appropriates, transfers, or credits to the fund and any
5252 gifts, grants, or donations the enterprise may receive for the fund. The bill
5353 directs the enterprise to leverage money in the provider stabilization fund
5454 to obtain federal matching money.
5555 The bill establishes a provider stabilization fund enterprise support
5656 board to assist the enterprise in implementing and administering the
5757 provider stabilization fund. The enterprise's governing board is required
5858 to submit an annual report on the provider stabilization fund to specified
5959 committees, the governor, and the medical services board in the
6060 department of health care policy and financing.
6161 Be it enacted by the General Assembly of the State of Colorado:1
6262 SECTION 1. Legislative declaration. (1) The general assembly2
6363 finds and determines that:3
6464 (a) Medicaid, the program administered by the department of4
6565 health care policy and financing under the name "Health First Colorado", 5
6666 is an essential public health coverage program that pays for health care6
6767 for more than 1.2 million Coloradans;7
6868 (b) Medicaid is also a critical component of Colorado's broader8
6969 health care system, with thousands of health care providers relying on9
7070 SB25-290-2- payments from medicaid to help sustain their businesses as they serve1
7171 Coloradans;2
7272 (c) Medicaid has a positive impact on Colorado's economy, as3
7373 evidenced by data from a 2016 report commissioned by the Colorado4
7474 Health Foundation showing that, after the medicaid program expansion5
7575 made possible by the federal "Patient Protection and Affordable Care6
7676 Act" and Senate Bill 13-200, the state's economy experienced an increase7
7777 in the state gross domestic product, an increase in jobs, an increase in8
7878 annual household earnings, and an increase in general fund revenues;9
7979 (d) During the public health emergency caused by the COVID-1910
8080 pandemic, the federal government allowed all people enrolled in medicaid11
8181 as of March 2020 to retain their benefits during the period of the public12
8282 health emergency, which lasted until May 2023;13
8383 (e) Following the public health emergency, the federal14
8484 government required the state to conduct eligibility redeterminations for15
8585 all medicaid enrollees;16
8686 (f) Before the eligibility redetermination, 1.8 million Coloradans17
8787 were enrolled in the state's medicaid program, and as of May 2024, the18
8888 state's medicaid enrollment dropped by over 500,000 to 1.27 million;19
8989 (g) From spring of 2023 to spring of 2024, Colorado health care20
9090 providers experienced significant increases in the demand for care from21
9191 uninsured Coloradans, suggesting that many Coloradans who lost22
9292 medicaid eligibility became uninsured; and23
9393 (h) The increased demand for uncompensated care has had24
9494 destabilizing financial effects on safety net providers, leading to reduced25
9595 access to care for many Coloradans.26
9696 (2) The general assembly therefore declares that it is:27

9898 -3- (a) Enacting the provider stabilization fund as a short-term1
9999 solution intended to stabilize certain safety net providers; and2
100100 (b) Committed to:3
101101 (I) Protecting vital primary care safety net infrastructure in the4
102102 state;5
103103 (II) Ensuring Colorado communities can provide access to care for6
104104 their residents; and7
105105 (III) Working toward long-term sustainability for Colorado's8
106106 health-care safety net.9

163163 to acknowledge that by providing the business services specified in2
164164 subsections (2)(d)(I) and (2)(d)(II) SUBSECTIONS (2)(d) AND (2)(d.3) of3
165165 this section, the Colorado healthcare affordability and sustainability4
166166 enterprise engages in an activity conducted in the pursuit of a benefit,5
167167 gain, or livelihood and therefore operates as a business;6
168168 (3) Colorado healthcare affordability and sustainability7
169169 enterprise. (a) The Colorado healthcare affordability and sustainability8
170170 enterprise referred to in this section as the "enterprise", is created. The9
171171 enterprise is and operates as a government-owned business within the10
172172 state department for the purpose of:11
173173 (I) Charging and collecting the healthcare affordability and12
174174 sustainability fee;13
175175 (II) Leveraging
176176 REVENUE FROM THE healthcare affordability and14
177177 sustainability fee revenue
178178 AND IN THE PROVIDER STABILIZATION FUND to15
179179 obtain federal matching money; and16
180180 (III) Utilizing and deploying:17
181181 (A) The healthcare affordability and sustainability fee revenue and18
182182 federal matching money to provide the business services specified in19
183183 subsections (2)(d)(I) and (2)(d)(II) of this section to hospitals that pay the20
184184 healthcare affordability and sustainability fee;
