26	26	The bill requires the state auditor to conduct or cause to be

36	36	in the department of public health and environment and the division of
37	37	labor standards and statistics in the department of labor and employment
38	38	(divisions). The audits will determine whether each of the divisions
39	39	effectively and efficiently performs and fulfills its statutory obligations.
40	40	The initial audit of the air pollution control division must begin in
41	41	calendar year 2026, with an additional audit occurring in calendar year
42	42	2031, and more frequently in the state auditor's discretion. The initial
43	43	audit of the division of labor standards and statistics must begin in
44	44	calendar year 2027, with an additional audit occurring in calendar year
45	45	2032, and more frequently in the state auditor's discretion. The state
46	46	auditor, in their discretion, may conduct additional audits of the divisions
47	47	after the first 2 audits have been completed. Upon completion of an audit,
48	48	the state auditor is required to submit a written report about the audit to
49	49	the legislative audit committee.
50	50	Be it enacted by the General Assembly of the State of Colorado:1
51	51	SECTION 1. In Colorado Revised Statutes, add 2-3-131 and2
52	52	2-3-132 as follows:3
53	53	2-3-131. Performance audit - air pollution control division -4

55	55	URING THE 2026 AND 2031 CALENDAR YEARS, AND MORE5
56	56	FREQUENTLY IN THE STATE AUDITOR 'S DISCRETION, THE STATE AUDITOR6
57	57	SHALL CONDUCT OR CAUSE TO BE CONDUCTED A PERFORMANCE AUDIT OF7
58	58	THE AIR POLLUTION CONTROL DIVISION IN THE DEPARTMENT OF PUBLIC8
59	59	HEALTH AND ENVIRONMENT TO DETER MINE WHETHER THE AIR POLLUTION9
60	60	CONTROL DIVISION IS EFFECTIVELY AND EFFICIENTLY PERFORMING AND10
61	61	FULFILLING THE DIVISION'S STATUTORY OBLIGATIONS. THEREAFTER, THE11
62	62	STATE AUDITOR, IN THEIR DISCRETION, MAY CONDUCT OR CAUSE TO BE12
63	63	CONDUCTED ADDITIONAL PERFORMANCE AUDITS OF THE AIR POLLUTION13
64	64	CONTROL DIVISION PURSUANT TO THIS SECTION . UPON COMPLETION OF A14
65	65	PERFORMANCE AUDIT, THE STATE AUDITOR SHALL SUBMIT A WRITTEN15
66	66	REPORT ABOUT THE PERFORMANCE AUDIT TO THE LEGISLATIVE AUDIT16

73	73	AUDIT OF THE DIVISION OF LABOR STANDARDS AND STATISTICS CREATED5
74	74	IN SECTION 8-1-103 (1) TO DETERMINE WHETHER THE DIVISION OF LABOR6
75	75	STANDARDS AND STATISTICS IS EFFECTIVELY AND EFFICIENTLY7
76	76	PERFORMING AND FULFILLING THE DIVISION 'S STATUTORY OBLIGATIONS.8

78	78	HEREAFTER, THE STATE AUDITOR, IN THEIR DISCRETION, MAY CONDUCT9
79	79	OR CAUSE TO BE CONDUCTED ADDITIONAL PERFORMANCE AUDITS OF THE10
80	80	DIVISION OF LABOR STANDARDS AND STATISTICS PURSUANT TO THIS11
81	81	SECTION. UPON COMPLETION OF A PERFORMANCE AUDIT , THE STATE12
82	82	AUDITOR SHALL SUBMIT A WRITTEN REPORT ABOUT THE PERFORMANCE13
83	83	AUDIT TO THE LEGISLATIVE AUDIT COMMITTEE .14
84	84	SECTION 2. Act subject to petition - effective date. This act15
85	85	takes effect at 12:01 a.m. on the day following the expiration of the16
86	86	ninety-day period after final adjournment of the general assembly; except17
87	87	that, if a referendum petition is filed pursuant to section 1 (3) of article V18
88	88	of the state constitution against this act or an item, section, or part of this19
89	89	act within such period, then the act, item, section, or part will not take20
90	90	effect unless approved by the people at the general election to be held in21
91	91	November 2026 and, in such case, will take effect on the date of the22
92	92	official declaration of the vote thereon by the governor.23
