3434 Money appropriated for operational costs must be used as agreed upon by
3535 the constituent institutions in baseline service level agreements. Any
3636 service or performance level agreement that the Auraria higher education
3737 center enters into using money appropriated for the 2025-26 state fiscal
3838 year must:
3939 ! Be executed by all contracting parties no later than
4040 September 1, 2025;
4141 ! Clearly describe the services, service and staffing levels,
4242 and performance expectations that are contracted for; and
4343 ! Provide that, if costs for services exceed the prices
4444 provided for in the contract, those excessive costs will not
4545 be assumed or incurred until an additional contract is
4646 executed or the original contract is amended.
4747 In the 2025-26 state fiscal year, the Auraria higher education
4848 center shall manage all resources related to baseline service level
4949 agreements and goals and shall present quarterly updates to the
5050 constituent institutions regarding baseline service level agreements and
5151 goals. For other services for the 2025-26 state fiscal year that are not
5252 already contracted for in the baseline service level agreements, the
5353 Auraria higher education center shall establish fee structures, and the
5454 constituent institutions shall enter into agreements with the Auraria higher
5555 education center for the provision of those services.
5656 The bill requires the constituent organizations to contract with an
5757 independent third-party entity that shall conduct the Auraria
5858 comprehensive study (study). The constituent institutions and the Auraria
5959 higher education center shall agree upon which independent third-party
6060 entity will conduct the study before executing a contract to select the
6161 independent third-party entity. If the constituent institutions and the
6262 Auraria higher education center do not agree upon an independent
6363 third-party entity by August 1, 2025, the Colorado commission on higher
6464 education shall, no later than December 31, 2025, select the independent
6565 third-party entity from options proposed by the constituent institutions.
6666 The study must examine the operations of the Auraria campus and
6767 the services provided to students by the constituent institutions and by the
6868 Auraria board of directors through the Auraria higher education center.
6969 The independent third-party entity shall present a report on the findings
7070 of the study.
7171 The study must include the following:
7272 ! A review of all plans and studies conducted in the past 15
7373 years regarding the mission, vision, and development of the
7474 Auraria campus;
7575 ! An evaluation of the statutory design and mission of the
7676 Auraria campus;
7777 ! An evaluation of the current governance model of the

8080 ! An evaluation of the operations and management structures
8181 under the current governance model of the Auraria campus;
8282 ! A comparison of the current governance model to
8383 alternative governance models which may yield greater
8484 efficiencies in service delivery; and
8585 ! An evaluation of the financial supports and structures of
8686 Auraria campus governance and operations.
8787 The constituent institutions shall enter into a cost-sharing
8888 agreement to pay for the study using gifts, grants, and donations.
8989 The bill reduces the general fund appropriation made in the annual
9090 general appropriation act for the 2025-26 state fiscal year to the
9191 department of higher education for the college opportunity fund program
9292 for fee-for-service contracts with state institutions by $31,435,042. The
9393 bill appropriates $31,435,042 from the general fund to the department of
9494 higher education for use by the Auraria higher education center.
9595 Be it enacted by the General Assembly of the State of Colorado:1

394394 SECTION 2. Appropriation - adjustments to 2025 long bill.26
395395 (1) To implement this act, appropriations made in the annual general27

399399 (a) The general fund appropriation for the college opportunity3
400400 fund program for fee-for-service contracts with state institutions pursuant4
401401 to section 23-18-303.5, C.R.S., is decreased by $31,435,042;5
402402 (b) The reappropriated funds appropriations from fee-for-service6
403403 contracts with state institutions pursuant to section 23-18-303.5, C.R.S.,7

415415 Metropolitan state university of Denver, and the regents of the university19

417417 SECTION 3. Appropriation. (1) For the 2025-26 state fiscal21
418418 year, $31,435,042 is appropriated to the department of higher education22
419419 for use by the Auraria higher education center. This appropriation is from23
420420 the general fund. To implement this act, the department may use this24
421421 appropriation as follows: 25
422422 (a) $29,545,253 for operational costs; and26
423423 (b) $1,889,789 for deferred maintenance projects.27

426426 determines, and declares that this act is necessary for the immediate2
427427 preservation of the public peace, health, or safety or for appropriations for3
