2424 AN ACT PROHIBITING SMOKING IN LICENSED CHILD CARE FACILITIES.

2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

2828 Section 1. (NEW) (Effective October 1, 2010) (a) As used in this section:

3030 (1) "Smoke" or "smoking" means the lighting or carrying of a lighted cigarette, cigar, pipe or similar device; and

3232 (2) "Customary business hours" means the hours that a family day care home is in operation caring for children.

3434 (b) Notwithstanding the provisions of section 31-40q of the general statutes, no person shall smoke in any area of, or on the grounds of, a child day care center or group day care home licensed by the Department of Public Health.

3636 (c) Notwithstanding the provisions of section 31-40q of the general statutes, no person shall smoke in any area of, or on the grounds of, a family day care home licensed by the Department of Public Health during the family day care home's customary business hours.

3838 (d) Any person who violates any provision of this section shall have committed an infraction.
