AN ACT REQUIRING NOTICE TO AN INSURED FOR REPAIR OR REMEDIATION FOLLOWING A COVERED LOSS UNDER A PERSONAL OR COMMERCIAL RISK POLICY.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That section 38a-313a of the general statutes be amended to require an insurer to provide, following a loss covered under a personal or commercial risk policy that requires repair or remediation, written notice to an insured that such insured has the right to choose the person who will perform such repair or remediation, and to prohibit the insurer from issuing authorization for direct payment to such person if such statement was not included or provided to the insured.
Statement of Purpose:
To require notice to an insured that he or she may choose the person who will perform the repair or remediation for a loss covered under a personal or commercial risk policy.
