AN ACT REQUIRING MINORS TO WEAR HELMETS IN COMMERCIAL BASEBALL BATTING CAGES. 

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective from passage) (a) No person under eighteen years of age may enter into a commercial baseball batting cage unless such person is wearing protective headgear of a type which conforms to the minimum specifications established by regulations adopted under subsection (b) of this section.

(b) Not later than January 1, 2012, the Commissioner of Consumer Protection shall adopt regulations in accordance with the provisions of chapter 54 of the general statutes, establishing minimum specifications for protective headgear for use by persons under eighteen years of age in commercial baseball batting cages.

(c) Failure to comply with this section shall not be a violation or an offense. Failure to wear protective headgear as required by subsection (a) of this section shall not be considered to be contributory negligence on the part of the parent or guardian of the person under eighteen years of age nor shall such failure be admissible in any civil action.
