1224 AN ACT CONCERNING THE PREVENTION OF EXCESSIVE PENSIONS FOR ELECTED MUNICIPAL OFFICIALS.

1426 Be it enacted by the Senate and House of Representatives in General Assembly convened:

16-Section 1. (NEW) (Effective October 1, 2011) Except as otherwise provided by charter, by ordinances or resolutions adopted pursuant to such charter or by home rule ordinance, no town, city, district or borough shall, within one hundred twenty days preceding the date of an election, grant to any elected municipal official any benefit by increasing such official's pension benefits plan. Nothing in this section shall prevent any such official from receiving any scheduled benefit in accordance with such official's pension benefits plan. The provisions of this section shall not apply to elected officials in towns in which the legislative body is the town meeting.
28+Section 1. (NEW) (Effective October 1, 2011) Notwithstanding the provisions of any special act, municipal charter or ordinance to the contrary, no town, city, district or borough shall grant to any elected municipal official during such official's term of office any benefit by changing the pension benefits plan in effect at the beginning of such official's term of office, provided nothing in this section shall prevent such official from receiving any scheduled benefit in accordance with such pension benefits plan in effect at the beginning of such official's term of office. The provisions of this section shall not apply to elected officials in towns in which the legislative body is the town meeting.
