AN ACT ENCOURAGING PRIVATE INVESTMENT IN THE INFRASTRUCTURE OF THE STATE. Be it enacted by the Senate and House of Representatives in General Assembly convened: That the Departments of Transportation and Public Works and the Office of Policy and Management may, under a competitive sealed proposals procurement approach, solicit proposals and enter into contracts with the private sector for design-build-finance-operate-maintain or design-build-operate-maintain services involving the sale, lease, operation and maintenance of a "transportation facility"; that "transportation facility" means infrastructure, including roads, airports, seaports, parking facilities, rail facilities, or similar facility, that is open to the public and used for the transportation of persons or goods; that unsolicited proposals may be considered, subject to a competitive bidding process. Statement of Purpose: To encourage private investment in the state's infrastructure.
