2424 AN ACT CONCERNING IMMUNITY FOR THE OWNERSHIP OR MAINTENANCE OF AN AUTOMATIC EXTERNAL DEFIBRILLATOR.

2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

2828 Section 1. (NEW) (Effective October 1, 2011) Any person who owns or maintains an automatic external defibrillator for emergency use by employees of the person or members of the public in a building or portion thereof that is open to the public shall not be liable for acts or omissions related to such ownership or maintenance which may constitute ordinary negligence if the person: (1) Maintains, inspects and services the automatic external defibrillator, the battery for the automatic external defibrillator and the electrodes for the automatic external defibrillator in accordance with the guidelines established by the manufacturer of the automatic external defibrillator; (2) stores the automatic external defibrillator in a location from which the automatic external defibrillator may be retrieved during normal hours of operation or occupancy; and (3) clearly indicates the presence and location of the automatic external defibrillator.

4646 To provide immunity for any person who owns or maintains an automatic external defibrillator in any building or portion thereof that is open to the public, provided the automatic external defibrillator is maintained in accordance with the manufacturer's standards, the automatic external defibrillator may be readily retrieved and the location of the automatic external defibrillator is clearly indicated.
