| 26 | 26 | Be it enacted by the Senate and House of Representatives in General Assembly convened: | |

| 28 | 28 | Section 1. (NEW) (Effective October 1, 2011) Any person who owns or maintains an automatic external defibrillator for emergency use by employees of the person or members of the public in a building or portion thereof that is open to the public shall not be liable for acts or omissions related to such ownership or maintenance which may constitute ordinary negligence if the person: (1) Maintains, inspects and services the automatic external defibrillator, the battery for the automatic external defibrillator and the electrodes for the automatic external defibrillator in accordance with the guidelines established by the manufacturer of the automatic external defibrillator; (2) stores the automatic external defibrillator in a location from which the automatic external defibrillator may be retrieved during normal hours of operation or occupancy; and (3) clearly indicates the presence and location of the automatic external defibrillator. | |
