2424 AN ACT CONCERNING CIVIL ACTIONS AGAINST THE STATE AND MUNICIPALITIES FOR THE SEXUAL ASSAULT OF CHILDREN.

2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

(NEW) (Effective October 1, 2011) Any person may bring a civil action in the Superior Court against the state or any political subdivision of the state, or any employee, officer or agent thereof, to recover damages for personal injury to a minor, including emotional distress, caused by sexual abuse, sexual exploitation or sexual assault. The defense of sovereign immunity or governmental immunity shall not be available in such action. The rights and liability of the state or a political subdivision of the state, or an employee, officer or agent thereof, in such action shall be coextensive with and shall equal the rights and liability of private persons in like circumstances.
