26 | 26 | Be it enacted by the Senate and House of Representatives in General Assembly convened: | |

28 | 28 | Section 1. (Effective from passage) The Department of Transportation shall identify locations in proximity to interstate highways which shall serve as refuge areas during inclement weather. Upon order of the Governor, refuge areas shall be made available to motor vehicles which leave highways during inclement weather. Refuge areas may include state parks, commuter parking lots, parking areas at state facilities and, with the permission of private property owners, private property. Any private property owner who allows his or her property to be used as a refuge area during inclement weather shall be held harmless against any liability claims resulting from the use of such property as a refuge area during inclement weather. | |

(Effective from passage) The Department of Transportation shall prepare a plan, within available appropriations, identifying (1) locations that may be used as refuge areas during inclement weather, and (2) methods, policies and procedures for their use, and shall submit such plan to the joint standing committee of the General Assembly having cognizance of matters relating to transportation not later than October 1, 2011. | |
