2424 AN ACT CONCERNING CIVIL ACTIONS AGAINST THE STATE BY MINORS SEXUALLY ASSAULTED WHILE IN THE CUSTODY OF THE STATE.

2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

2828 Section 1. (NEW) (Effective October 1, 2011) Any person may bring an action in the Superior Court against the state or any state officer or employee to recover damages for personal injury to a minor, including emotional distress, caused by sexual abuse, sexual exploitation or sexual assault that occurred while such minor was in the custody of the state on account of being charged with or convicted of a delinquent act. The defense of sovereign immunity shall not be available in such action and the rights and liability of the state or a state officer or employee in such action shall be coextensive with and shall equal the rights and liability of private persons in like circumstances.
