5 | 12 | AN ACT CONCERNING RECOMMENDATIONS FROM THE COMMISSION ON NONPROFIT HEALTH AND HUMAN SERVICES RELATING TO PURCHASE OF SERVICE CONTRACTS. | |

(NEW) (Effective July 1, 2011) Notwithstanding the provisions of section 4-70b of the general statutes and chapter 62 of the general statutes, each state agency that enters into a personal service agreement or a purchase of service agreement with a service provider for the provision of public health services or human services shall, within available appropriations: (1) Execute such agreement not later than fifteen business days prior to the date of the commencement of services under the terms of the agreement; (2) not later than forty-five calendar days after receipt of a provider's request for payment under the terms of the agreement, submit to the service provider, full payment of the amount due to the service provider or submit to the service provider written notice stating the reason for the agency's refusal to pay, in whole or in part, the amount due; (3) enter into agreements that include conditions and terms that cover more than a one-year period; (4) in consultation with the Secretary of the Office of Policy and Management, (A) standardize purchase of service agreements and contract compliance forms, (B) streamline processes for service providers to enter into personal service agreements and purchase of service agreements with a state agency, by methods that include, but are not limited to, the elimination of redundant forms, and (C) develop standardized methods to collect and retain information on cost methodologies and data, which the secretary shall aggregate, annually, to enable each state agency to track data trends, become more efficient and make recommendations for policy changes; (5) accept an electronic signature from a service provider for a personal service agreement, purchase of service agreement or financial report; and (6) make an electronic payment or an electronic funds transfer to a service provider for payment under the terms of a personal service agreement or purchase of service agreement. | |

27 | - | (d) The secretary shall establish uniform policies and procedures for obtaining, managing and evaluating the quality and cost effectiveness of direct health and human services purchased from a private provider organization or municipality. The secretary shall require all state agencies which purchase direct health and human services to comply with such policies and procedures. | |

29 | - | (e) Purchase of service contracts shall be subject to the competitive procurement provisions of sections 4-212 to 4-219, inclusive. The secretary may waive the competitive procurement requirements set forth in chapter 55a with respect to any purchase of service contract between a state agency and a private provider of human services. | |

(Effective July 1, 2011) (a) The Secretary of the Office of Policy and Management shall, in consultation with the Nonprofit Liaison to the Governor and representatives of nonprofit, community-based providers of health and human services, shall, within available appropriations, conduct a study of the feasibility of establishing a state-wide data warehouse for the storage of public and private health and human services data to enable each state agency to track data trends, operate more efficiently and make recommendations for policy changes. | |

37 | - | (b) Not later than January 1, 2012, the Secretary of the Office of Policy and Management shall report, in accordance with the provisions of section 11-4a of the general statutes, on the study conducted pursuant to subsection (a) of this section to the joint standing committees of the General Assembly having cognizance of matters relating to human services and government administration and elections. | |
