AN ACT CONCERNING MUNICIPAL IMMUNITY FOR THE NEGLIGENT ACTS OR OMISSIONS OF EMPLOYEES, OFFICERS AND AGENTS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That subparagraph (B) of subdivision (2) of subsection (a) of section 52-557n of the general statutes be amended to clarify that municipal immunity for negligent acts or omissions which require the "exercise of judgment or discretion" of municipal employees, officers or agents shall apply at the planning or decision making level but shall not apply at the operational level.
Statement of Purpose:
To clarify the scope of municipal immunity for the negligent acts or omissions of employees, officers and agents.
