2421 AN ACT CONCERNING EMPLOYER NOTICE TO EMPLOYEES REGARDING MANDATORY OVERTIME.

2623 Be it enacted by the Senate and House of Representatives in General Assembly convened:

28-Section 1. (NEW) (Effective January 1, 2012) (a) As used in this section:

30-(1) "Employee" means any person engaged in service to an employer in the business of the employer; and

32-(2) "Employer" means any person, firm, business, educational institution, nonprofit agency, corporation, limited liability company or other entity, including the state and any political subdivision thereof, that employs twenty-five or more employees.

34-(b) No employer may require an employee to work more than eight hours of overtime per pay period without, at least twenty-four hours prior to the commencement of such overtime, providing the employee with written or verbal notice that such overtime is required.

36-(c) No employer shall discharge, discipline, penalize or in any manner discriminate against any employee because the employee refused to work more than eight hours of overtime without receiving notice from the employer in accordance with subsection (b) of this section.
