Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective October 1, 2011) Whenever the State Traffic Commission receives an application from any person for an activity that will require local approval from a municipal planning commission, zoning commission, combined planning and zoning commission or inland wetlands commission, said commission shall not require such person to obtain such local approval before accepting such application for filing and shall process such application to the extent practicable without such local approval. Sec. 2. (Effective from passage) On or before February 1, 2012, the Legislative Program Review and Investigations Committee shall submit to the joint standing committee of the General Assembly having cognizance of matters relating to planning and development an analysis of local and state-wide land use permitting requirements and procedures. Such study shall include, without limitation, an analysis of the interplay between state and local approval requirements and an identification of redundant and unduly burdensome steps or requirements that may hinder economic development in the state.
