AN ACT CONCERNING THE DEPARTMENT OF SOCIAL SERVICES' IMPLEMENTATION OF POLICIES AND PROCEDURES RELATING TO THE PATIENT PROTECTION AND AFFORDABLE CARE ACT AND THE HEALTH CARE AND EDUCATION RECONCILIATION ACT.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective from passage) The Commissioner of Social Services may implement policies and procedures necessary to carry out mandatory or optional provisions of the Patient Protection and Affordable Care Act, P.L. 111-148 and the Health Care and Education Reconciliation Act of 2010, P.L. 111-152 while in the process of adopting such policies and procedures in regulation form, provided: (1) The commissioner provides written notice to the joint standing committees of the General Assembly having cognizance of matters relating to human services and appropriations and the budgets of state agencies not later than ten days prior to implementing such policies and procedures; and (2) the commissioner prints notice of intention to adopt the regulations in the Connecticut Law Journal not later than twenty days after implementing such policies and procedures. The notice provided by the commissioner in accordance with subdivision (1) of this section shall include a summary of the policies and procedures to be implemented, a reference to the federal statutory authority for such policies and procedures, and an estimate of the fiscal impact on the state or any municipality of the state. Policies and procedures implemented pursuant to this section shall be valid until the time final regulations are effective.

To allow the Department of Social Services to implement certain policies and procedures prior to adopting such policies and procedures in regulation form.
