AN ACT CONCERNING THE PURVIEW OF THE LEGISLATIVE REGULATION REVIEW COMMITTEE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective upon certification by the Secretary of the State of the vote approving the constitutional amendment permitting the General Assembly or a committee of the General Assembly to direct an agency to amend or repeal an administrative regulation) The regulation review committee, as defined in section 4-189h of the general statutes, may review any regulation, as defined in section 4-166 of the general statutes, of any agency, as defined in section 4-166 of the general statutes, to determine whether the regulation is obsolete or outdated or is too onerous on persons, as defined in section 4-166 of the general statutes, who are required to comply with the regulation. As part of such review, the regulation review committee shall schedule a public hearing at which the committee may consider testimony of the agency and the public concerning the regulation under review. If, following such hearing, the committee determines that the regulation is obsolete or outdated or is too onerous on the persons who are required to comply with the regulation, the committee may direct the agency to amend or repeal such regulation, in accordance with the committee's directive, provided the committee also notifies the joint standing committee of the General Assembly having cognizance of matters relating to the subject matter of the regulation of such directive.

 


This act shall take effect as follows and shall amend the following sections:

Statement of Purpose: 

To expand the purview of the legislative regulation review committee to permit the committee to direct an agency to amend or repeal any regulation the committee finds to be obsolete or outdated, or too onerous on the regulated community.
