AN ACT EXPANDING FEE IN LIEU OF OPEN SPACE PROGRAMS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
Section 1. Section 8-25b of the general statutes is repealed and the following is substituted in lieu thereof (Effective October 1, 2013):
Any municipality [which] that provides in regulations, adopted pursuant to section 8-25, for the payment of a fee or the fair market value of land transferred in lieu of any requirement to provide open space, shall deposit any such payments in a fund which shall be used for the purpose of preserving open space, constructing or maintaining sidewalks or acquiring additional land for open space or for recreational or agricultural purposes.
This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:
To authorize towns to use fee in lieu of open space payments to fund the establishment and maintenance of sidewalks.
