2121 AN ACT CONCERNING THE AWARD OF NONECONOMIC DAMAGES IN MEDICAL MALPRACTICE ACTIONS.

2323 Be it enacted by the Senate and House of Representatives in General Assembly convened:

2525 That section 52-572h of the general statutes be amended to limit recovery of noneconomic damages resulting from personal injury or wrongful death, whether in tort or in contract, when it is alleged that such injury or death resulted from the professional negligence of a health care provider or health care institution, or both, in the medical diagnosis, care or treatment of the claimant, to not more than (1) three hundred thousand dollars for each health care provider per event, (2) three hundred thousand dollars for each health care institution per event, and (3) eight hundred thousand dollars overall for each event.
