AN ACT AUTHORIZING FEES IN LIEU OF SIDEWALK CONSTRUCTION. Be it enacted by the Senate and House of Representatives in General Assembly convened: That section 8-25 of the general statutes be amended to provide that the planning commission of a municipality may require the provision of sidewalks when and in locations deemed proper by such commission, and that such commission may enact subdivision regulations that (1) allow an applicant to pay a fee in lieu of installing all or a portion of any required sidewalks, provided such fee does not exceed the estimated cost of such installation, (2) require any such fee to be deposited into a fund to be used for the installation or improvement of sidewalks or multi-use trails in locations deemed appropriate by the legislative body of the municipality, and (3) provide incentives, such as reduced fees, for developers who choose to pay a fee in lieu of sidewalks, provided such incentives shall be approved by a two-thirds majority vote of the planning commission. Statement of Purpose: To authorize towns to accept a fee from developers in lieu of sidewalk construction and to provide flexibility in funding sidewalk infrastructure.
