AN ACT CONCERNING THE EARNED RISK REDUCTION CREDIT PROGRAM.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 18-98e of the general statutes be amended to prohibit any person convicted of one or more of the following crimes from earning risk reduction credit toward a reduction in such person's sentence: (1) Manslaughter in the first degree under section 53a-55 of the general statutes, (2) manslaughter in the first degree with a firearm under section 53a-55a of the general statutes, (3) assault in the first degree under section 53a-59 of the general statutes, (4) assault of an elderly, blind, disabled or pregnant person or a person with intellectual disability in the first degree under section 53a-59a of the general statutes, (5) assault of a pregnant woman resulting in termination of pregnancy under section 53a-59c of the general statutes, (6) sexual assault in the first degree under section 53a-70 of the general statutes, (7) aggravated sexual assault of a minor under section 53a-70c of the general statutes, (8) sexual assault in the third degree with a firearm under section 53a-72b of the general statutes, (9) kidnapping in the first degree under section 53a-92 of the general statutes, (10) kidnapping in the first degree with a firearm under section 53a-92a of the general statutes, (11) burglary in the first degree under section 53a-101 of the general statutes, (12) arson in the first degree under section 53a-111 of the general statutes, (13) robbery in the first degree under section 53a-134 of the general statutes, (14) employing a minor in an obscene performance under section 53a-196a of the general statutes, and (15) being a persistent operating while under the influence felony offender under section 53a-40f of the general statutes.

Statement of Purpose: 

To protect the public by prohibiting persons convicted of serious felonies from participating in the earned risk reduction credit program.
