AN ACT AUTHORIZING MUNICIPALITIES TO FUND CONSTRUCTION OF SOUND BARRIERS ALONG INTERSTATE HIGHWAYS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That the general statutes be amended to empower a municipality to authorize the issuance of bonds under the provisions of section 7-369 of the general statutes, the proceeds of which shall be paid to the Department of Transportation and used by the department as a municipal contribution of not more than one hundred per cent towards the cost of planning, designing and constructing sound barriers along an interstate highway, provided: (1) At least fifty per cent of the owners of benefited properties within two hundred fifty yards of such interstate highway petition the municipality to construct such sound barriers along the interstate highway; (2) the municipality holds a public hearing on the issue; (3) the municipality assesses all benefited properties for the purpose of paying for such bonds and for the cost of issuing such bonds; (4) any benefit assessment that remains unpaid for more than thirty days after the due date for payment of such assessment constitutes a lien upon the property against which the assessment was levied; and (5) "benefited property" means any residential property in a municipality located within an area designated by the municipality.
Statement of Purpose:
To authorize certain municipalities to issue bonds to provide funds for the construction of sound barriers.
