Be it enacted by the Senate and House of Representatives in General Assembly convened: That the general statutes be amended to: (1) Substitute a reference to the Probate Court rules of procedure for the probate practice book, and make a conforming change to refer to the new "financial report" under the probate practice book; (2) amend section 17a-525 of the general statutes to eliminate the requirement that an appellant in a psychiatric civil commitment matter must give bond for an appeal; (3) amend section 45a-186 of the general statutes to overrule the case of Follacchio v. Follacchio by clarifying that all conservatorship matters are on the record for appeal purposes; (4) amend section 45a-436 of the general statutes to clarify that the date of mailing of a decree triggers the period for a spousal election; (5) amend section 45a-484 of the general statutes to increase the amount for termination of small trusts to parallel the amount for termination of charitable trusts under section 45a-520 of the general statutes; (6) amend section 45a-648 of the general statutes to allow application for involuntary representation up to one hundred eighty days prior to a person's eighteenth birthday; (7) amend section 45a-656b of the general statutes to include a person under voluntary representation in the change of residence requirements; (8) expand the circumstances under which a court may appoint an estate examiner; (9) amend section 45a-364 of the general statutes to permit the use of probate magistrates and attorney probate referees, rather than commissioners, to hear and decide claims in decedents' estates, and repeal related sections that refer to commissioners; (10) repeal section 45a-726a of the general statutes which permits the Commissioner of Children and Families or child placing agency to consider a prospective adoptive parent's sexual orientation when placing a child for adoption or foster care; and (11) repeal section 45a-727b of the general statutes to eliminate language that does not endorse same sex marriage, civil union or other form of relation between unmarried persons. Statement of Purpose: To enact the Probate Court Administrator's proposed revisions to certain statutes concerning the Probate Courts.
