AN ACT CONCERNING COURT FEES IN AFFORDABLE HOUSING APPEALS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That the general statutes be amended to provide that if a developer appeals the denial of an affordable housing application and the municipality prevails, the developer shall be liable for the legal costs incurred by the municipality in defending the appeal.
Statement of Purpose:
To discourage frivolous appeals by developers of affordable housing.
