Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective July 1, 2013) (a) No certified employee with an endorsement in physical education shall serve as an instructor of a physical education course that makes use of a swimming pool unless such person (1) is a certified lifeguard, (2) is certified in cardiopulmonary resuscitation, pursuant to section 19a-113a-1 of the regulations of Connecticut state agencies, as amended from time to time, and (3) has completed a course in first aid offered by the American Red Cross, the American Heart Association, the Department of Public Health or any director of health, as certified by the agency or director of health offering the course. (b) A local or regional board of education that offers a physical education course that makes use of a swimming pool may allow a person who meets the requirements of subdivisions (1) to (3), inclusive, of subsection (a) of this section, and is sixteen years of age or older to assist in the instruction of such physical education course, provided such person is supervised by the certified employee described in subsection (a) of this section. (c) Any physical education course that makes use of a swimming pool shall have at least one instructor who satisfies the qualifications of subsection (a) of this section. Any such physical education course that has more than twenty-five students shall have at least one person who satisfies the qualifications of subsection (a) of this section and at least one additional person who satisfies the qualifications of subsection (a) or (b) of this section. (d) Any local or regional board of education that offers a physical education course that makes use of a swimming pool shall develop a swimming pool safety plan. Such swimming pool safety plan shall include, but not be limited to, best practices regarding swimming pool safety and be in accordance with the provisions of this section and the requirements of the Public Health Code of this state established by the Commissioner of Public Health under the provisions of section 19a-36 of the general statutes. Sec. 2. (Effective July 1, 2013) Not later than July 1, 2014, the Commissioner of Public Health shall adopt regulations, in accordance with the provisions of chapter 54 of the general statutes, to amend sections 19-13-B33b, 19-13-B34 and 19-13-B36 of the regulations of Connecticut state agencies to include swimming pools and natatoriums located at schools.
