2424 AN ACT CONCERNING THE USE OF AN AUTOMATED NUMBER PLATE RECOGNITION SYSTEM.

2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

2828 Section 1. (NEW) (Effective October 1, 2013) (a) For the purposes of this section:

3030 (1) "Authorized agent or employee" means an authorized agent or employee under subsection (b) of this section;

3232 (2) "Automated number plate recognition system" means a system of one or more mobile or fixed high-speed cameras used in combination with optical character recognition technology software that detects the presence of a number plate affixed to a motor vehicle, captures the image of the number plate, converts the image into computer readable data, stores such data together with the date, time and location of such captured image in a database and links such data to other applications or compares such data to data stored in other databases;

3434 (3) "Commercial motor vehicle" means a commercial motor vehicle, as defined in section 14-1 of the general statutes;

3636 (4) "Motor vehicle" means a motor vehicle, as defined in section 14-1 of the general statutes; and

3838 (5) "Number plate" means a number plate, as defined in section 14-1 of the general statutes.

4040 (b) No person may use an automated number plate recognition system unless such person is the authorized agent or employee of (1) the Department of Transportation, for the purpose of protecting public safety and preserving and maintaining state highways, (2) the Department of Emergency Services and Public Protection, for the purpose of screening or inspecting commercial motor vehicles, or (3) a municipal police department or the Division of State Police within the Department of Emergency Services and Public Protection, for the purpose of protecting public safety, conducting criminal investigations and ensuring compliance with municipal ordinances, regulations and bylaws and state and federal laws. An authorized agent or employee of such agency may use an automated number plate recognition system only for legitimate purposes within the scope of such agent's or employee's employment.

4242 (c) An automated number plate recognition system may reference only information entered by an authorized agent or employee based on specific and articulable facts of a concern for public safety or a criminal investigation, or pursuant to records of a civil court order or records from the National Crime Information Center database or an official bulletin published by a law enforcement agency.

4444 (d) Notwithstanding the provisions of section 1-216 of the general statutes, data collected through the use of an automated number plate recognition system pursuant to subsection (b) of this section that is retained by an agency shall be reviewed and destroyed by the agency not later than fourteen days after it was collected if the existence of criminal activity with respect to such data cannot be corroborated.

4646 (e) Any person who violates any provision of this section shall, subject to the provisions of sections 5-141d, 7-465 and 29-8a of the general statutes, be liable to any person who is the subject of such violation in an action at law, suit in equity or other proper proceeding for redress.
