| 34 | - | (b) The Commissioner of Social Services shall amend the Medicaid state plan to require that the community spouse of an institutionalized person receives the maximum community spouse protected amount pursuant to 42 USC 1396r-5(f)(2) for a period of five years after the institutionalized spouse becomes eligible for Medicaid under Title XIX of the Social Security Act. | |
