Introduced by:

AN ACT CONCERNING THE CIVIL PENALTY FOR THE FAILURE OF CERTAIN MOTOR VEHICLE OPERATORS TO MAINTAIN MOTOR VEHICLE LIABILITY INSURANCE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That (a) section 14-12g of the general statutes be amended to waive the civil penalty of two hundred dollars levied against a registered motor vehicle owner that is required to prevent or rescind the suspension of such owner's motor vehicle registration for failure of such owner to maintain motor vehicle liability insurance, provided (1) such owner, not later than five days after receiving notification from such owner's insurance company pursuant to section 38a-343 of the general statutes that such owner's insurance has been cancelled and that the Commissioner of Motor Vehicles may suspend such owner's registration, contacts the Department of Motor Vehicles to state that such owner's insurance was cancelled due to nonpayment related to a change in such owner's personal financial circumstances, and (2) the department confirms the change in such owner's personal financial circumstances, and (b) the general statutes be amended to provide that the department shall allow any such owner, upon reacquiring motor vehicle liability insurance, to register such owner's vehicle without additional cost for the remainder, if any, of the time period of the previously suspended registration.

Statement of Purpose:

To avoid penalizing certain motor vehicle operators who, due to a change in personal financial circumstances, fail to maintain motor vehicle liability insurance and have their motor vehicle registrations suspended.
