AN ACT CONCERNING THE REQUIRED PRESENCE OF CERTAIN PERSONS AT FORECLOSURE MEDIATION PROCEEDINGS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 49-31n of the general statutes be amended to provide that (1) a representative of the mortgage lender, who possesses the authority to settle the proceeding, shall be required to attend the third mediation session pertaining to the action and any mediation session held thereafter, and (2) a default in favor of the mortgagor shall enter if the mortgage lender does not ensure that a representative with settlement authority attends such mediation sessions.

Statement of Purpose: 

To require a mortgage lender to ensure that a representative of the lender who possesses authority to settle the action is in attendance at certain foreclosure mediation sessions.
