AN ACT CONCERNING THE DEATH PENALTY.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That chapter 952 of the general statutes be amended to reinstate the crime of capital felony, punishable by death, for any person convicted under section 53a-54b of the general statutes when the forensic and other evidence of the crime presented at trial establishes guilt by absolute certainty, rather than the lower standard of proof beyond a reasonable doubt, which evidence may include DNA evidence or other reliable scientific evidence of guilt.

Statement of Purpose: 

To allow imposition of the death penalty for eligible crimes when guilt is established with absolute certainty.
