AN ACT ESTABLISHING A PROTOCOL CONCERNING THE CHAIN OF CUSTODY FOR PERSONAL PROPERTY TRANSFERRED BY AN ARRESTED PERSON TO A POLICE OFFICER.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective July 1, 2013) (a) Not later than January 1, 2014, the Commissioner of Emergency Services and Public Protection, in consultation with the Police Officer Standards and Training Council, shall jointly develop a protocol concerning the chain of custody of any personal property transferred by an arrested person to a police officer, as defined in section 7-294a of the general statutes. The commissioner shall ensure that the time period for the chain of custody protocol developed pursuant to this section commences at the time the person is arrested and continues until such time as the arrested person is released from custody by the law enforcement unit, as defined in section 7-294a of the general statutes.

(b) Each police basic or review training program conducted or administered by the Division of State Police within the Department of Emergency Services and Public Protection, the Police Officer Standards and Training Council or a municipal police department shall include training on the protocol developed pursuant to subsection (a) of this section.

Statement of Purpose: 

To require the Commissioner of Emergency Services and Public Protection, in consultation with the Police Officer Standards and Training Council, to jointly develop a protocol concerning the chain of custody of personal property transferred by an arrested person to a police officer.
