2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

(NEW) (Effective from passage) Notwithstanding any provision of the general statutes, in determining whether a wastewater treatment plant has reached ninety per cent or more of its design flow, the Department of Energy and Environmental Protection shall make such determination based upon a three-hundred-sixty-five day rolling average.

46+To reduce the effect of short-term high flows when assessing whether a wastewater treatment plant reaches ninety per cent of its design flow and, as a result of such level, the municipality must undertake a facilities plan study for expansion of such plant.
