AN ACT STAYING A TERM OF INCARCERATION DURING THE PENDENCY OF AN APPEAL OF A FAMILY COURT ORDER.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That the general statutes be amended to provide that, if in a family court matter one of the parties is ordered to be incarcerated and such party appeals the order of incarceration, such party shall not be incarcerated during the pendency of the appeal. 

Statement of Purpose: 

To provide parties to a family court matter with certain clearly defined rights and protections against wrongful incarceration during the pendency of an appeal of an order entered in such family court matter.
