AN ACT CONCERNING COURT AUTHORITY TO WITHHOLD INTEREST PAYMENTS IN FORECLOSURE PROCEEDINGS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 49-31n of the general statutes be amended to provide that a court may withhold interest payments in a foreclosure proceeding upon finding that a lender has not demonstrated good faith when participating in the foreclosure mediation program.

Statement of Purpose: 

To provide an incentive for lenders to demonstrate good faith in foreclosure mediation proceedings.
