2424 AN ACT CONCERNING THE APPOINTMENT OF SUCCESSOR TRUSTEES.

2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

2828 That chapter 802c of the general statutes be amended to provide that: (1) The current trustee or, if none, the current income beneficiary or the majority of such beneficiaries of an irrevocable inter vivos trust or a revocable inter vivos trust, after the death of the settlor or grantor, may petition the Probate Court of the jurisdiction in which the settlor or grantor of such trust resides or resided at death to appoint a successor trustee for such trust or a trustee of any subtrust under such trust, in the event that no such trustee is named in the trust or the named person or institution is unable or unwilling to so serve, and (2) a Probate Court judge shall have the option of making such appointment or of declining to do so.
