2424 AN ACT CONCERNING STATE CONTRACTS FOR HUMAN SERVICES.

2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

2828 Section 1. Section 4-70b of the general statutes is amended by adding subsection (g) as follows (Effective from passage):

3030 (NEW) (g) On and after July 1, 2015, the secretary shall establish uniform policies and procedures for state agency contracts for health and human services to require, within available appropriations: (1) Uniform rates of reimbursement based on the actual cost of the services provided; (2) review by the secretary and agencies of rates and cost standards every two years to reflect changes in reasonable costs due to inflation or changes in the consumer price index for urban consumers; (3) the establishment of an appeal process for providers if rates do not reflect the actual costs of services; and (4) when establishing rates, consideration of (A) the reasonable cost to providers of any existing or new mandate by the state, (B) changes in the reasonable costs of goods and services, and (C) differences in wages, benefits, housing and real estate costs in each metropolitan area of the state and in any municipality within such area if costs within the municipality are substantially higher than the average cost within the metropolitan area as a whole.

3232 Sec. 2. (NEW) (Effective from passage) On and after July 1, 2015, the Commissioners of Developmental Services, Children and Families, Mental Health and Addiction Services, Public Health and Social Services shall, within available appropriations, set reimbursement rates for providers who enter into purchase of service contracts for the delivery of health and human services in accordance with section 4-70b of the general statutes, as amended by this act.
