AN ACT LIMITING THE TAKING OF REAL PROPERTY BY MUNICIPALITIES BY EMINENT DOMAIN.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That sections 7-148 and 8-193 of the general statutes be amended to prohibit a municipality from taking property pursuant to eminent domain unless there is clear evidence that the property will be used (1) for municipal purposes, or (2) for a project by a public-private partnership that will deliver demonstrable positive economic impact.
Statement of Purpose:
To limit the ability of towns to take private property.
