2424 AN ACT ESTABLISHING A PILOT PROGRAM FOR AUTOMATED SPEED ENFORCEMENT DEVICES.

2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

2828 Section 1. (Effective July 1, 2016) (a) For the purposes of this section, "automated speed enforcement device" means a device that (1) is designed to automatically record an image of the license plate of a motor vehicle that is traveling at a speed in excess of the speed limit established for a street, road, highway or parking area, and (2) indicates on the recorded image the date, time and location of the violation and the speed of the motor vehicle.

3030 (b) Municipalities with populations of less than three thousand two hundred persons may conduct a pilot program authorizing the use of automated speed enforcement devices by law enforcement agencies of such municipalities to enforce violations of any ordinance regulating the speed of motor vehicles or of section 14-218a or 14-219 of the general statutes. A municipality participating in the pilot program shall utilize not more than two automated speed enforcement devices.

3232 (c) A municipality participating in the pilot program may, by ordinance, authorize the use of not more than two automated speed enforcement devices to enforce the provisions of any ordinance regulating the speed of motor vehicles.

3434 (d) Whenever a violation of an ordinance regulating the speed of motor vehicles or of section 14-218a or 14-219 of the general statutes is detected and recorded by an automated speed enforcement device, a sworn police officer shall review the recorded image. If, after such review, such officer authorizes the issuance of a citation for such violation, the law enforcement agency shall, not later than five days after the alleged violation, mail a citation to the registered owner of the motor vehicle and a copy of the recorded image or images produced by the automated speed enforcement device. Proof of the registration number of the motor vehicle therein concerned shall be prima facie evidence that the owner was the operator of the motor vehicle, except that, in the case of a leased or rented motor vehicle, such proof shall be prima facie evidence that the lessee was the operator of the motor vehicle, as provided by subsection (b) of section 14-107 of the general statutes. A citation shall not be issued under this subsection unless a sign was posted in close proximity to the automated speed enforcement device not less than thirty days prior to such use providing notice to operators of motor vehicles that an automated speed enforcement device may be used.

3636 (e) An automated speed enforcement device used by a municipality pursuant to this section shall be activated and record images only upon detecting the approach of a motor vehicle and a probable violation.
