1224 AN ACT CONCERNING ACCOUNTABILITY FOR THE EARNED RISK REDUCTION CREDIT PROGRAM.

1426 Be it enacted by the Senate and House of Representatives in General Assembly convened:

16-Section 1. (Effective from passage) Not later than January 1, 2018, the Commissioner of Correction, in accordance with the provisions of section 11-4a of the general statutes, shall report to the joint standing committee of the General Assembly having cognizance of matters relating to the judiciary, all of the commissioner's recommendations concerning the program that permits an inmate to earn risk reduction credits pursuant to section 18-98e of the general statutes, to enhance the program by (1) providing graduated sanctions for a second and subsequent offense of inmate misconduct, (2) identifying offenses that would lead to the (A) partial loss of an inmate's credits, and (B) total loss of an inmate's credits, and (3) improving compliance by inmates with their inmate offender accountability plans.
28+Section 1. Subsection (b) of section 18-98e of the general statutes is repealed and the following is substituted in lieu thereof (Effective October 1, 2017):

30+(b) An inmate may earn risk reduction credit for adherence to the inmate's offender accountability plan, for participation in eligible programs and activities, upon successful completion of any such program or activity, and for good conduct and obedience to institutional rules as designated by the commissioner, provided (1) good conduct and obedience to institutional rules alone shall not entitle an inmate to such credit, and (2) the inmate fully adheres to the inmate's offender accountability plan. The commissioner or the commissioner's designee (A) shall cause the loss of (i) all or any portion of such earned risk reduction credit if an inmate fails to adhere to the inmate's offender accountability plan, and (ii) all such earned risk reduction credit if an inmate tests positive on a drug test, and (B) may, in his or her discretion, cause the loss of all or any portion of such earned risk reduction credit for any other act of misconduct or insubordination or refusal to conform to recommended programs or activities or institutional rules occurring at any time during the service of the sentence or for other good cause. If an inmate has not earned sufficient risk reduction credit at the time the commissioner or the commissioner's designee orders the loss of all or a portion of earned credit, such loss shall be deducted from any credit earned by such inmate in the future.
